Passenger rights for an overbooked flight

Were you in time at the check-in desk, but denied boarding the flight? It’s possible that your flight is overbooked. Did you arrive at your destination with more than three hours’ delay, and did the airline not give you a satisfactory reason why you were denied boarding? According to Regulation 261/2004 and The Air Passenger Rights and Air Travel Organisers’ Licensing (Amendment) (EU Exit) Regulations 2019 you may be entitled to compensation.

To be entitled to denied boarding compensation, your flight must meet the following requirements:

  • You flew from an EU country
  • Or you flew from outside the EU to a country within the EU with a European airline
  • Or depart from an airport in the United Kingdom and the flight was operated by an UK airline
  • You arrived with more than three hours’ delay at your final destination

With denied boarding, it is important that your boarding pass was printed at the airport so we can show that you were there on time. There are some situations when airlines may deny boarding to passengers in which case you have no right to compensation. Valid reasons for denied boarding are drunk behaviour, health concerns, incomplete travel documents and security reasons.

That’s a lot of rules and exceptions to check if you are entitled to compensation. Simply make it easy on yourself and claim your compensation with EUclaim.

If you are entitled to compensation because you are refused boarding, the amount is based on the distance of the flight
