Passenger rights for a missed flight connection

Regulation 261/2004 and The Air Passenger Rights and Air Travel Organisers’ Licensing (Amendment) (EU Exit) Regulations 2019 safeguards your rights from the moment you miss a connecting flight due to the delay or cancellation of your first flight. Regulation 261/2004 is a European regulation and The Air Passenger Rights and Air Travel Organisers’ Licensing (Amendment) (EU Exit) Regulations 2019 is an UK regulation. Therefore your right to compensation for a missed connection only applies when:

  • You fly from an EU country
  • Or if you fly from outside the EU to a country within the EU with a European airline
  • Or depart from an airport in the United Kingdom and the flight was operated by an UK airline.

It is also stated in Regulation 261/2004 and The Air Passenger Rights and Air Travel Organisers’ Licensing (Amendment) (EU Exit) Regulations 2019 that you are only entitled to compensation when you arrive at your end destination with a delay of more than three hours.

Missed connections due to extraordinary circumstances

There are situations in which you are not entitled to compensation. This is the case when ‘extraordinary circumstances’ apply and the airline can show that they were not responsible for the missed connection. Examples of extraordinary circumstances include missed connections due to bad weather conditions, strikes and acts of terrorism.

Example: You are flying from London to New York. You have a connecting flight in Amsterdam and both flights are under one booking. Your flight from London to Amsterdam is delayed by 45 minutes and you are no longer able to make your connecting flight. The next possible flight to New York leaves in 12 hours. In this situation you may be entitled to compensation according to The Air Passenger Rights and Air Travel Organisers’ Licensing (Amendment) (EU Exit) Regulations 2019.

Amount of compensation for missed connections

If you are entitled to compensation for a missed connection, the amount is based on the distance to your final destination.

Calculate the distance of your flight

  • €250* compensation for a flight up to 1500 km
  • €400* compensation for a flight between 1500 and 3500 km
  • €600* compensation for a flight exceeding 3500 km

With a flight distance of 3,500 km or more and a delay of between three and four hours, you are entitled to 50% of the compensation amount according to the Sturgeon ruling.

The route with which you flew and the airline that performed the airline are key in determining if your will fall with the scope of the EC 261 regulation (and be entitled to Euro’s) or the The Air Passenger Rights and Air Travel Organisers’ Licensing (Amendment) (EU Exit) Regulations 2019 (and be entitled to GBP).
